Terms of Use

Article 1 (Purpose)

The purpose of these Terms of Service is to establish the basic matters, including the rights and obligations, responsibilities, conditions of use, and procedures between Viewduc Insight (hereinafter referred to as the “Company”) and members in connection with the use of the Viewduc website and related services (hereinafter referred to as the “Service”) provided by the Company.

Article 2 (Definitions)

1. “Service” means all online services provided by the Company, including cosmetics, brand, and ingredient information; search, comparison, and ranking functions; reviews and ratings; questions, answers, and comments; ingredient-checking tools; routine and similar-product discovery; and events.
2. “Member” means a person who agrees to these Terms of Service, enters into a service agreement with the Company, and uses the Service.
3. “Non-member” means a person who uses the public areas of the Service without registering as a member.
4. “Post” means reviews, ratings, photographs, questions, answers, comments, edit suggestions, and other information posted or registered by a member on the Service.
5. “Content” means all information provided or posted on the Service by the Company or members, including product, brand, and ingredient information; descriptions; statistics; rankings; comparison and recommendation results; and Posts.
6. Terms not defined in these Terms of Service shall be governed by applicable laws and regulations, individual policies, and generally accepted service practices.

Article 3 (Posting and Amendment of the Terms)

1. The Company shall post the contents of these Terms of Service on linked screens within the Service or by other means so that members can easily review them.
2. The Company may amend these Terms of Service to the extent that such amendments do not violate applicable laws and regulations, including the Act on the Regulation of Terms and Conditions.
3. If the Company amends these Terms of Service, it shall specify the effective date and the reasons for the amendment and, in principle, announce the amendment beginning 7 days before the effective date. Material changes or changes unfavorable to members shall, in principle, be announced beginning 30 days before the effective date, and individual notice shall be provided by a method enabling members to review the notice when necessary.
4. Changes requiring separate consent under applicable laws and regulations shall follow the procedures prescribed by those laws and regulations.
5. A member who does not agree to the amended Terms of Service may terminate the service agreement. The Company shall not deem a member to have consented to matters requiring consent under applicable laws and regulations solely because the member has not responded.

Article 4 (Interpretation of the Terms and Operating Policies)

1. Matters not specified in these Terms shall be governed by applicable laws and regulations and generally accepted service practices.
2. Reviews, business operator and brand activities, and community use shall be subject, in addition to these Terms, to the 「Review Writing Guidelines」, 「Business Operator/Brand Guidelines」, and 「Community Policy and Operational Measures」 separately disclosed by the Company.
3. If the contents of an individual policy conflict with these Terms, the applicable individual policy shall take precedence with respect to the specific matter; however, it shall not be interpreted in a manner contrary to applicable laws and regulations.

Article 5 (Formation of the Service Agreement and Restrictions on Membership)

1. The service agreement is formed when a person wishing to become a member agrees to these Terms and the required consents, applies for membership in accordance with the procedures established by the Company, and the Company accepts the application.
2. Only persons aged 14 or older may register as members of the Service.
3. The Company may reject an application falling under any of the following subparagraphs or terminate the service agreement thereafter.
   • Where the applicant has stolen another person's information or provided false information
   • Where the applicant is below the age eligible for membership
   • Where an improper purpose, such as re-registering to evade service sanctions, is identified
   • Where the application materially violates applicable laws and regulations or these Terms
   • Where there is a substantial risk of seriously harming the safety or reliability of the Service

Article 6 (Management of Member Information and Accounts)

1. Members shall provide accurate information and shall endeavor to keep information that can be changed within the Service up to date when it changes.
2. Members shall not allow a third party to use their accounts or authentication methods and shall notify the Company without delay upon becoming aware of account theft or abnormal access.
3. To the extent permitted by applicable laws and regulations, a member may be responsible for issues arising from the member's intentional or negligent improper sharing of account information.

Article 7 (Protection of Personal Information)

The Company protects members' personal information in accordance with applicable laws and regulations, including the Personal Information Protection Act (of Korea), and specific matters concerning the collection, use, storage, entrustment, and exercise of rights relating to personal information shall be governed by the 「Privacy Policy」 separately disclosed by the Company.

Article 8 (Obligations of the Company)

1. The Company shall comply with applicable laws and regulations and these Terms and shall make reasonable efforts to provide continuous and stable Service.
2. The Company shall establish security measures to protect members' personal information and disclose a Privacy Policy.
3. The Company shall make reasonable efforts to address legitimate opinions or complaints raised in connection with the use of the Service.
4. As a general principle, the Company shall not apply its operating policies differently solely on the basis of whether a review is positive or negative or the commercial relationship between the Company and a business operator.

Article 9 (Obligations of Members)

Members shall not engage in any of the following acts.

• Entering false information or impersonating another person during the registration or information-change process
• Posting false reviews that differ from actual user experiences, manipulated ratings, or compensated reviews
• Manipulating review, rating, recommendation, or report results through multiple accounts, automated means, account trading, or similar methods
• Infringing upon another person's rights, including personal information, reputation, copyrights, trademark rights, or rights of publicity
• Posting illegal information, malware, spam, excessive advertising content, or content involving threats, harassment, hatred, or discrimination
• Bypassing the Service's security functions or interfering with its normal operation
• Collecting, reproducing, or redistributing Service data in bulk or bypassing protective measures without the Company's prior permission
• Engaging in any other act that violates applicable laws and regulations, these Terms, or an individual operating policy

Article 10 (Service Content and Provision)

The Company may provide the following services.

• Search and viewing of cosmetics, brands, full ingredient lists, and ingredient information
• User participation features, including reviews, ratings, questions and answers, and comments
• Product search and comparison, similar product discovery, rankings, statistics, and personalized information
• Ingredient-checking tools, routines, and other beauty information tools
• Events and community features
• Links to external brands, sellers, and information provider websites
• Other features added by the Company in accordance with the purpose of the Service

The Service is primarily provided through free features. If separate paid features are introduced in the future, the Company will separately provide notice of the necessary details, including the terms of use, prices, and cancellation conditions.

Article 11 (Changes to and Suspension of the Service)

1. The Company may change all or part of the Service due to service improvements, operational or technical needs, changes in applicable laws and regulations, or other reasons.
2. The Company may temporarily restrict or suspend the provision of the Service where unavoidable circumstances exist, including maintenance, malfunctions, communication disruptions, security incidents, natural disasters, or disruptions to third-party services.
3. The Company will provide advance notice, to the extent reasonably practicable, of the termination of the Service or material changes that significantly affect Members’ rights. In cases involving urgent security or legal reasons, notice may be provided afterward.

Article 12 (Notice Regarding Cosmetics, Ingredients, and Recommendation Information)

1. Products, ingredients, functions, comparisons, rankings, recommendations, and reviews displayed through the Service are intended to provide general information.
2. The Service does not replace medical care, diagnosis, or treatment provided by a medical institution, or medication counseling provided by a pharmacist.
3. A product’s full ingredient list, volume, directions for use, precautions, sales status, and other information may differ from the actual product due to changes made by the manufacturer or brand, product differences by country, or the timing of data updates. Users must ultimately verify the product’s official labeling.
4. Personalization, similarity, ranking, and recommendation results are reference information based on the data and criteria established by the Company and do not guarantee any particular effect, safety, purchase outcome, or suitability for an individual.

Article 13 (External Websites and Affiliate Links)

1. The Service may include links to brands, manufacturers, sellers, or other third-party websites.
2. Some external links may be affiliate links, and the Company may receive affiliate revenue if a user conducts a transaction on an external website through such a link. Where necessary, the Service will disclose this in a readily noticeable manner.
3. The Company is not a party to the sale of products conducted on external websites. Products, prices, inventory, payments, shipping, refunds, and the processing of personal information on external websites are subject to the policies and responsibility of the applicable business operator.

Article 14 (Management of Posts)

1. If a post violates applicable laws and regulations, these Terms, or an individual operating policy, the Company may take measures to the extent necessary, including restricting its display, making it unavailable, excluding it from calculations, deleting it, or requesting its modification.
2. The Company may use technical and operational means to detect potential policy violations, including spam, review manipulation, duplicate content, and abnormal account activity.
3. Reviews that are made unavailable or deleted may be excluded from ratings, review counts, rankings, and related statistics.
4. If a Member objects to an action taken by the Company, the Member may request a review in accordance with the procedures provided by the Company.

Article 15 (Rights in and License to Use Posts)

1. As a general rule, copyrights and other rights in posts directly created by a member belong to that member or the legitimate rights holder.
2. By posting content on the Service, the member grants the Company a non-exclusive, royalty-free license to store, reproduce, transmit, display, and convert the format of the applicable post to the extent necessary to provide, operate, and protect the Service; facilitate search exposure; conduct statistics and analysis; perform technical format conversions; and introduce the post within the Service.
3. If the Company intends to use a member's post commercially for separate advertising materials or other purposes unrelated to the Service, it will separately obtain the necessary rights or consent.
4. Members must possess the rights necessary for the content they post and must not post another person's content without authorization.

Article 16 (Review and Community Policies)

1. Reviews must be written independently based on the member's actual experience using the product.
2. A review may not be permitted if the reviewer has received or been offered financial compensation, free products, samples, discounts, points, coupons, opportunities to win prizes, or other economic benefits from a brand, manufacturer, seller, marketing agency, or other interested party in connection with writing, modifying, or deleting the review.
3. Events independently operated by the Company for participation in the Service may be conducted in accordance with separate event criteria, provided that participation is not conditioned on a positive evaluation of a particular brand or a particular rating.
4. Detailed standards concerning the operation of reviews and the community are governed by separate guidelines and policies.

Article 17 (Reports of Rights Infringement and Temporary Measures)

1. A person who claims that their rights, including privacy or reputation, have been infringed by information publicly disclosed through the Service may identify the content at issue and the grounds for the alleged infringement and request that the Company delete the content, publish a rebuttal, or take necessary measures.
2. The Company will notify the applicant and the poster of the necessary information in accordance with applicable laws and may temporarily restrict access to the information to the extent permitted by law if it is difficult to immediately determine whether a rights infringement has occurred or a dispute between the parties is anticipated.
3. Reports of other rights infringements, including copyright and trademark infringement, will also be handled in accordance with applicable laws and the Company's procedures.

Article 18 (Restrictions on Use and Termination of Agreement)

1. A member may request termination of the Service Agreement at any time through the withdrawal function within the Service or a customer support channel.
2. If a member violates applicable laws, these Terms, or a separate operating policy, the Company may take measures including a warning, content restriction, feature restriction, temporary suspension, or termination of the Service Agreement, taking into account the nature, recurrence, intentionality, and risk level of the violation.
3. In cases of organized review manipulation, account takeover, illegal acts, or other serious conduct that threatens the security of the Service, the Company may immediately take necessary measures without prior warning.
4. If a member objects to a restriction on use, the member may request a reconsideration by emailing [email protected].

Article 19 (Scope of Liability)

1. The Company operates the Service with the degree of care required under applicable laws.
2. If the Service cannot be provided due to circumstances that are difficult for the Company to reasonably control, including natural disasters, war, failures of telecommunications carriers, or reasons attributable to users, the Company's liability will be determined within the scope prescribed by applicable laws.
3. The Company does not warrant in advance the accuracy of all posts written by users or third parties. However, it may take necessary measures when a report, review, or legal requirement so warrants.
4. If a member suffers damages due to the Company's intent or negligence, the Company will be liable in accordance with applicable laws.
5. This Article does not limit any rights of users or any liability of the Company that may not be excluded or limited under applicable laws.

Article 20 (Notices)

The Company may provide information necessary for operating the Service through reasonable means, including notices within the Service, the email address registered by a member, and notifications. Matters common to multiple members may be communicated through a notice within the Service, and if applicable laws require individual notice, the Company will use the method required by those laws.

Article 21 (Governing Law and Jurisdiction)

1. The laws of the Republic of Korea shall apply to these Terms and matters related to the use of the Service.
2. If a dispute arises between the Company and a Member, they shall endeavor to resolve it through mutual consultation. If litigation is necessary, the court of competent jurisdiction shall be determined in accordance with the Civil Procedure Act and other applicable laws.
